Nothing in these Terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

1. Quotations and Agreement

1.1 All work is carried out on the basis of a written quotation and/or written technical specification agreed between Modish Construction Ltd and the client before work begins.

1.2 The written quotation, technical specification, and any subsequently agreed written variations together form the entire agreement between the parties. Verbal discussions not confirmed in writing do not form part of the agreed contract.

2. Price and Payment

2.1 The total contract price is as stated in the written quotation, based on the materials, scope, and specification agreed at that time. The quotation will state whether the price includes VAT.

2.2 Unless otherwise agreed in writing, payments are made in stages as work progresses, at intervals agreed between the parties.

2.3 Payment may be made by bank transfer or cash. A written receipt will be provided for any payment made in cash.

2.4 Any request by the client for a staged payment to be delayed, reduced, or withheld outside the agreed payment schedule may affect the project timeline and our ability to purchase materials or continue works.

2.5 Where a payment is not made in accordance with the agreed schedule, we reserve the right to suspend works until payment is received and to charge statutory interest on the overdue amount in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable, or otherwise at a reasonable commercial rate.

3. Variations and Additional Work

3.1 Any change requested by the client to the materials, dimensions, layout, colour, or specification after the contract has been agreed, including upgrading to a different or more expensive material, is treated as a variation.

3.2 Variations may result in an adjustment to the price and/or programme. Where a client independently purchases a material that was originally included in our contract price, the amount originally allowed for that material within the contract price will be deducted accordingly.

3.3 We recommend that all variations are confirmed in writing (including by text message or email) before work proceeds, to avoid any misunderstanding.

4. Materials

4.1 Unless otherwise agreed, Modish Construction Ltd is responsible for sourcing and purchasing all materials required to complete the agreed works, in accordance with the agreed specification.

4.2 We do not accept responsibility for materials purchased or introduced to the site by the client or any third party without our prior instruction or agreement.

4.3 If a client wishes to supply their own materials, this must be agreed in writing in advance, and Modish Construction Ltd's workmanship guarantee will not extend to defects arising from client-supplied materials.

4.4 Where any existing structure, fixture, or feature at the site (including but not limited to fencing, gates, posts, walls, drains, or boundary features) is owned by, or is the responsibility of, a third party (including a local authority, council, or neighbour), it is the client's responsibility to identify this to us in writing before work begins. We accept no liability for costs, claims, or reinstatement arising from work carried out on such structures where the client has not disclosed the third-party ownership or interest in advance.

5. Site Access and Conduct

5.1 The client is entitled to observe work being carried out at their own property.

5.2 To allow our team to work safely, efficiently, and to the agreed standard, we ask that any technical concerns, questions, or requested changes are directed to the site manager or company director, rather than given directly to individual workers.

5.3 All members of our team are expected to treat clients and their property with respect, and we equally expect our workers to be treated with courtesy and respect while on site.

5.4 For safety reasons, and given the nature of an active construction site, clients and other non-essential persons are asked to maintain a safe distance from ongoing works.

5.5 If the client, or anyone acting on the client's behalf, carries out any physical work on site that forms part of, or affects, the agreed scope of works (including but not limited to preparing, mixing, or applying materials such as cement, mortar, or grout) without our prior written agreement, we accept no responsibility for the performance, appearance, or durability of that element of the work, and our workmanship guarantee under Clause 6 will not extend to it.

5.6 Where the client restricts, delays, or refuses our access to the site, this may affect our ability to complete the works within the agreed programme. We reserve the right to charge for any additional time, labour, or costs reasonably incurred as a result, and any resulting delay will not be treated as a failure on our part to complete the works.

5.7 We reserve the right to take photographs and videos of work in progress and completed work for the purposes of quality control, record-keeping, and dispute resolution. Such images may also be used for our own promotional or portfolio purposes unless the client requests otherwise in writing.

6. Workmanship Guarantee

6.1 Modish Construction Ltd provides a written workmanship guarantee of between 5 and 10 years for the installation works carried out, depending on the materials used. The guarantee period applicable to your project will be confirmed in your individual written agreement.

6.2 If a genuine defect attributable to our workmanship arises within the guarantee period, please notify us in writing with details and, where possible, photographs. We will inspect the issue and carry out any necessary remedial work in accordance with the guarantee.

6.3 The guarantee does not cover damage or defects resulting from misuse, third-party interference, materials supplied by the client, work or materials introduced onto the site by the client without our agreement (see Clause 5.5), or work carried out by persons other than Modish Construction Ltd.

6.4 This guarantee is in addition to, and does not affect, your statutory rights.

7. Independent Inspection

7.1 If a dispute arises regarding the standard of work carried out, we are willing to agree to a joint, independent inspection by a suitably qualified professional, with findings to be shared with both parties in writing.

8. Cancellation

8.1 Where the contract is agreed away from our business premises or at a distance (for example by telephone, email, or messaging) with a consumer, you have the right to cancel the contract within 14 days without giving any reason, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The cancellation period expires 14 days after the day the contract is agreed.

8.2 To exercise the right to cancel, you must inform us of your decision by a clear statement (for example a letter, email, or text message) before the cancellation period expires.

8.3 If you expressly request that we begin work within the 14-day cancellation period and then cancel, you will be required to pay for the work carried out and materials supplied up to the point of cancellation, in proportion to the total contract price.

8.4 Either party may raise concerns regarding the continuation of the project at any time. Where a client wishes to end the agreement before completion (outside the 14-day cancellation period), a fair settlement will be calculated based on the work completed to date, materials purchased, and any costs already incurred, in accordance with the agreed contract price.

9. Communication

9.1 We aim to communicate professionally and respectfully at all times, and we ask that clients communicate with us in the same manner. Persistent abusive or disrespectful communication towards company representatives or members of our team may affect our ability to continue working on a project.

10. Complaints

10.1 If you are unhappy with any aspect of our work, please raise this directly with us in writing so that we have a fair opportunity to investigate and resolve the matter.

10.2 If a resolution cannot be reached, either party may seek independent advice or dispute resolution, including through Citizens Advice, an alternative dispute resolution (ADR) provider, or the courts.

11. Liability

11.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

11.2 Subject to clause 11.1 and to your statutory rights as a consumer, our liability for any claim arising from these Terms or the works carried out shall not exceed the total contract price.

11.3 Modish Construction Ltd holds public liability insurance, details of which are available on request.

12. Governing Law

12.1 These Terms and any contract formed with Modish Construction Ltd are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, save that if you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of your home nation.

13. Changes to These Terms

13.1 We may update these Terms from time to time. The version applicable to a specific project is the version in effect at the time the written quotation was agreed.

15. Acceptance

By signing below, or by accepting the written quotation, making a payment, or instructing Modish Construction Ltd to begin work, the client confirms they have read, understood, and agreed to these Terms and Conditions.
